These Terms of Use provide that all disputes between you and Lumin Lamp House will be resolved by BINDING ARBITRATION. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT TO ASSERT OR DEFEND YOUR RIGHTS UNDER THIS CONTRACT (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT A JUDGE OR JURY and your claims cannot be brought as a class action. Please review Section 20 for the details regarding your agreement to arbitrate any disputes with Lumin Lamp House co.
Care: Proper care of our products will ensure their long life. The Rustic Pelican is not responsible for damages caused by products through use.

If you are using the Service on behalf of an entity, organization, or company, you represent and warrant that you have the authority to bind such organization to these Terms and you agree to be bound by these Terms on behalf of such organization.

Payment. Certain activities through or features of the Service, such as placing an order, may require you to pay fees. Before you are required to pay any fees, you will have an opportunity to review and accept the applicable fees that you will be charged. A sales tax may be charged on any order placed through the Service, based on the location the order is billed to and the applicable sales tax in effect at the time of purchase. Each order will be subject to the applicable Terms in effect at the time of purchase. Except as expressly provided at the time you place an order or in any of the foregoing order-related terms, all fees are in U.S. Dollars and are non-refundable. Lumin Lamp House may change the fees for any activity through, or feature of, the Service, including by adding additional fees or charges, on a going-forward basis at any time. Lumin Lamp House, or its third-party payment processor, will charge the payment method you specify at the time of purchase. You acknowledge and agree that you may be responsible for the payment of certain processing or other transactional fees depending on the payment method you specify. You authorize Lumin Lamp House to charge, or to have charged on its behalf, all sums described herein to such payment method. If you pay any applicable fees with a credit card, Lumin Lamp House may seek pre-authorization of your credit card account prior to your purchase to verify that the credit card is valid and has the necessary funds or credit available to cover your purchase.
Risk of Loss. Except as otherwise set forth herein or in any applicable Additional Terms (as defined in Section 12.2 below), the risk of loss for and title to products purchased on or through the Service passes to you upon delivery to the carrier. For more information about shipping and delivery of products ordered through the Service, please review the Shipping + Delivery policy. Returns and Refunds. If you are not fully satisfied with a purchase made through the Service, you may be able to return it as set forth in the Returns policy .
Returns. Lumin Lamp House accepts returns on a vast majority of our products (in new, uninstalled condition and original packaging) within 5 days of receipt unless otherwise noted on the product page. Contact our Customer Service Team to initiate a return merchandise authorization (RMA). Once your return request has been authorized you will be sent shipping labels by email.(Some countrys are not covered by Lumin Lamp House shipping return lablels, please contact our Customer Service team to check your if your country is covered. If your country is not covered, the customer will select the shipping company for the return and provide Lumin Lamp House with the assigned tracking number). Simply print, attach the labels to the box and drop off at your local post office. If you prefer to use your own shipping account please provide us with the tracking number. Return authorizations expire 5 days after they are issued so please initiate procedure within this time frame.
If the labels are not used to return the item within 5 days, you have 7 more days to request new labels. If you don´t request new labels within this time frame, Lumin Lamp House will assume you decided to keep your purchase, therefore you won't be entitled to request a return or a refund for your order.
Product Availablity and Descriptions. Following your placement of an order through the Service, Lumin Lamp House may send an email or otherwise acknowledge that the order has been received; however, unless expressly stated therein, this does not signify confirmation of a products price or availability or indicate that the order has been accepted or shipped. While Lumin Lamp House strives to include accurate information and descriptions (including prices, images, specifications, and availability) of products on the Service, it does not warrant that such information is accurate, complete, reliable, current, or free of errors. Lumin Lamp House reserves the right, but is not obligated, to modify, correct, or update information relating to any products available through the Service at any time in its sole discretion, without prior notice. If you receive a product which is not as described on the Service at the time of your order, your sole and exclusive remedy is to return the unused product as permitted pursuant to Section 5 of these Terms.

You acknowledge and agree that you are solely responsible for any User Content that you post, submit, or publish and none of such User Content shall be subject to any obligation of confidence on the part of Lumin Lamp Houseor its agents, subsidiaries, affiliates, partners, suppliers, or third party service providers and their respective directors, officers, and employees. You understand that when using the Service you will be exposed to User Content from a variety of sources and acknowledge that User Content may be inaccurate, offensive, indecent or objectionable. Prohibited Conduct. Your rights to use the Service are expressly conditioned on your agreement not to:

9.2 - use the Service for any illegal purpose, or in violation of any local, state, national, or international law;

Additionally, Lumin Lamp House, in its sole discretion may terminate your user account on the Service or suspend or terminate your access to the Service or cancel orders (subject to a refund of any payments you have made with respect to unfulfilled orders) at any time, with or without notice. Lumin Lamp Housereserves all rights to the Materials not granted expressly in these Terms.
Indemnity. You agree that you will be responsible for your use of the Service, and you agree to defend, indemnify, and hold harmless Lumin Lamp Houseand its officers, directors, employees, consultants, affiliates, subsidiaries, suppliers, service providers, and agents (collectively, the "Lumin Lamp HouseEntities") from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with: (a) your access to, use of, or alleged use of the Service; (b) your violation of these Terms or any representation, warranty, or agreements referenced in the Terms, or any applicable law or regulation; (c) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right; or (d) any disputes or issues between you and any third party. COVID19 Disclaimer

Our teams are working overtime to produce and ship our top-quality lighting line of products to you, our customers around the world, as quickly as possible.
You may experience delays due to the number of orders being processed and extended lead times for shipping and delivery. So please, if your package has shipped allow 5-8 weeks for orders to be delivered during this extraordinary time in countries highly affected by the virus. Lumin Lamp House will not be held accountable for delivery delays caused by the pandemic.
All orders received after March 15th 2020 until said otherwise, will operate under a temporal Return Process. For the time being, and due to unstable fees of low-cost global shipping companies, Lumin Lamp House will remain unable to provide prepaid shipping labels for returns.
Returns will be processed by carriers picked by the customers, and once the item is received at an operating Lumin Lamp House warehouse, a full refund will be issued. pFor returns, lease contact our customer service team (customerservice@luminlamphouse.com), they will walk you through this temporal return process.

YOU AGREE THAT THE AGGREGATE LIABILITY OF THE LUMIN LAMP HOUSE ENTITIES TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF RELATING TO THE USE OF OR ANY INABILITY TO USE THE SERVICE (INCLUDING ANY MATERIALS, PRODUCTS, SERVICES, OR CONTENT AVAILABLE ON OR THROUGH THE SERVICE) OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO LUMIN LAMP HOUSEFOR THE SERVICE OR PRODUCT TO WHICH YOUR DISPUTE RELATES IN THE 12 MONTHS PRIOR TO THE CLAIM; OR (B) $50.

EACH PROVISION OF THESE TERMS THAT PROVIDES FOR A LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS TO ALLOCATE THE RISKS UNDER THESE TERMS BETWEEN THE PARTIES. THIS ALLOCATION IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH OF THESE PROVISIONS IS SEVERABLE AND INDEPENDENT OF ALL OTHER PROVISIONS OF THESE TERMS. THE LIMITATIONS IN THIS SECTION 17 WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Governing Law. These Terms will be governed by the laws of the United States of Mexico without regard to conflict of law principles. To the extent that any lawsuit or court proceeding is permitted under the Terms, you and Lumin Lamp House agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within Querétaro, Querétaro México for the purpose of litigating all such disputes.
General. These Terms, together with the Privacy Policy and any other agreements or applicable policies expressly incorporated by reference herein, constitute the entire and exclusive understanding and agreement between you and Lumin Lamp Houseregarding your use of and access to the Service, and except as expressly permitted above may be amended only by a written agreement signed by authorized representatives of all parties to these Terms. You may not assign or transfer these Terms or your rights under the Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice. The failure to require performance of any provision will not affect our right to require performance at any time thereafter, nor will a waiver of any breach or default of these Terms or any provision of these Terms constitute a waiver of any subsequent breach or default or a waiver of the provision itself. Use of section headers in these Terms is for convenience only and will not have any impact on the interpretation of particular provisions. In the event that any part of these Terms is held to be invalid or unenforceable, the unenforceable part will be given effect to the greatest extent possible and the remaining parts will remain in full force and effect.
Dispute Resolution and Arbitration
20.1 - Generally. In the interest of resolving disputes between you and Lumin Lamp House in the most expedient and cost effective manner, you and Lumin Lamp House agree that any and all disputes arising in connection with these Terms will be resolved by binding arbitration. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. Our agreement to arbitrate disputes includes, but is not limited to all claims arising out of or relating to any aspect of these Terms, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory, and regardless of whether the claims arise during or after the termination of these Terms. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND LUMIN LAMP HOUSE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
20.2- Arbitrator. Any arbitration between you and Lumin Lamp Housewill be governed by the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modified by these Terms, and will be administered by the AAA. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by contacting YDesign Group.
20.3 - No Class Actions. YOU AND LUMIN LAMP HOUSEAGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Lumin Lamp Houseagree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
Consent to Electronic Communications. By using the Service, you consent to receiving certain electronic communications from us as further described in our Privacy Policy. Please read our Privacy Policy to learn more about your choices regarding our electronic communications practices. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
